Welcome to Explore on Bike. These Terms and Conditions ("Terms") govern your use of our website, platform, and booking services. By accessing our platform or booking a tour, you agree to be bound by these Terms.
1. Definitions and Scope
"The Company": BGP Noleggio Srl, with registered office at Via Vittore Carpaccio 60, 00147 Roma, Italy (VAT ID: 17405641006), operating under the brand Explore on Bike. "Platform": The website, mobile applications, and booking systems managed by the Company. "Customer" / "You": Any individual or entity booking a tour or service through the Platform. "Partner" / "Local Operator": The independent local third-party company providing the actual e-bike rental and guided tour service. "Merchant of Record (MoR)": The Company acts as the Merchant of Record, processing payment and handling customer service in relation to bookings, while the execution of the tour is delivered by our selected Partners.
2. Bookings and Payment
2.1 Agreement: By booking a tour on our Platform, you enter into a contractual relationship with Explore on Bike for the management of your reservation, and directly with the Local Operator for the execution of the tour. 2.2 Payment Processing: All payments are processed securely through our authorised payment gateways (e.g. Stripe, PayPal). Charges will appear on your statement as "Explore on Bike" or "BGP Noleggio Srl". 2.3 Pricing: All prices are displayed in Euros (€) (or local currency where applicable) and include local taxes unless stated otherwise.
3. Cancellation, Weather, and Refund Policies
3.1 Standard Customer Cancellation: Save where a different notice period is expressly indicated on the relevant tour page, the Customer shall be entitled to a full refund of the amount paid, provided that the booking is cancelled no later than twenty-four (24) hours prior to the scheduled departure time of the tour (the "Standard Cancellation Window"). Cancellations notified less than twenty-four (24) hours prior to the scheduled departure time shall not entitle the Customer to any refund, whether in whole or in part. The same shall apply, without exception, in the event of a no-show. 3.2 Weather Policy ("Rain or Shine"): Tours operate under standard weather conditions, including light or intermittent rain. Where force majeure or severe adverse weather conditions (e.g. heavy storms, official weather warnings) compromise safety, the Local Operator or the Company may cancel the tour. In that event, the Customer will be offered a full refund or an alternative rescheduling date. 3.3 Optional Weather Insurance Policy ("Maltempo"): Where the Customer purchases the optional Weather Insurance Policy at checkout, the standard cancellation window is extended: the Customer may cancel the tour up to 10 hours prior to departure for a full refund, regardless of actual weather conditions.
4. Safety, Eligibility, and Participant Conduct
4.1 Mandatory Digital Waiver: It is a strict condition of participation that every adult guest (and a parent or guardian on behalf of any minor) completes and signs our Digital Liability Waiver via the WaiverForever platform prior to tour departure. 4.2 "No Signature, No Tour" Policy: Failure or refusal to complete the Digital Liability Waiver will result in immediate exclusion from the tour. In this scenario, no refund will be issued. 4.3 Physical and Technical Requirements: By booking, you warrant that you (and all participants in your party) have recent biking experience, can safely balance and operate a pedal-assist e-bike (EPAC) in urban traffic or on trails, and have no medical condition that would jeopardise your safety. 4.4 Technical Inability and Safety Discretion: Where the Local Operator or the Guide determines, at their sole discretion, that a Customer lacks the skills necessary to safely operate the vehicle, that Customer will be immediately excluded from the tour for safety reasons. In such cases, no refund, compensation, or rescheduling will be provided. 4.5 Customer Self-Declaration of Physical Limits: Weight limitations (typically up to 110–120 kg) and minimum height requirements apply. It is the Customer's responsibility to verify these standards on the specific tour page before booking. 4.6 Inappropriate Behaviour and Compliance: The Guide may terminate a Customer's tour immediately for repeated refusal to follow safety instructions, violations of local traffic laws, aggressive behaviour, or deliberate equipment damage. No refund or compensation will be issued. 4.7 Substance Policy: Participation may be denied without refund to any individual suspected of being under the influence of alcohol, drugs, or impairing medication. 4.8 Delayed Arrivals and Late Check-ins: Late arrivals who miss the safety briefing or group departure will be classified as a "No-Show." No refund, partial refund, or free rescheduling will be granted.
5. Limitation of Liability and Indemnification
5.1 Independent Operators: The Customer acknowledges that the tour, e-bike rental, and guiding services are executed exclusively by independent Local Operators. The Company acts solely as the digital platform and transaction manager. 5.2 Liability Cap: To the maximum extent permitted by applicable law, Explore on Bike (BGP Noleggio Srl) shall not be liable for any direct, indirect, incidental, or consequential damages, personal injuries, property damage, or theft arising out of or in connection with the execution of the local tour or equipment malfunction. 5.3 Customer Indemnity: You agree to indemnify and hold harmless the Company, its directors, and employees from any third-party claims, liabilities, or expenses arising from your negligence, violation of local traffic laws, or improper conduct during the tour.
6. Media Release and Privacy
6.1 Media Capture: As part of our service, guides may capture photos and videos during the tour. By signing the Digital Liability Waiver, you consent to the storage of this media on secure cloud platforms (e.g. Dropbox) and its delivery to tour participants. 6.2 Marketing Opt-in: Any data collected during the booking process is managed in strict compliance with the General Data Protection Regulation (GDPR). Your email will only be used for marketing purposes if you explicitly check the opt-in box during checkout.
7. Governing Law and Jurisdiction
7.1 Applicable Law: These Terms, and any dispute arising from or related to them, shall be governed by and construed in accordance with the laws of Italy. 7.2 Exclusive Forum: Any legal action, suit, or proceeding arising out of these Terms shall be brought exclusively before the Court of Rome (Tribunale di Roma), Italy.
